MAKATI GIVES BUSINESS ESTABLISHMENTS ONE YEAR TO PHASE OUT PLASTIC, STYRO CONTAINERS

Makati Mayor Jejomar Erwin S. Binay has signed the implementing rules of an ordinance that gives all business establishments in Makati one year to dispose of their inventory of plastic and styfoam containers and promotes the use of recyclable substitutes.

The guidelines encourage the use of plastic bags by business establishments selling dry and wet goods provided that they are biodegradable and/or recyclable. Likewise, environment-friendly or eco-friendly bags such as jute, fabric/cloth, paper bags and basket/woven bags made from pandan, coconut tree or buri/buli leaves, etc. may be provided by the management of such establishment for free or for a fee.

It also prohibits the distribution, sale and use of a) styrofoams (polysterene) and other materials with similar non-biodegradable components that are being used as food, drinks and beverages containers, and b) plastic dining utensils on all restaurants, fast food chains, canteens, eateries and similar establishments.

The said EO, as the Implementing Rules and Regulations of Sections 21, 22 and 23 of Ordinance No. 2003-095 prescribes the guidelines, procedures and standards, as well as facilitate compliance of business owners and to effectively and efficiently achieve the objectives of the ordinance.

Mayor Binay said indiscriminate dumping of plastics and styrofoams, besides being unsanitary would also hurt the environment since they would clog our drainage and waterways. “EO 0009 is a milestone issuance that strengthens our fight against global warming,” Mayor Binay added. This would greatly reduce the non-biodegradable materials and solid wastes that add up to the pollution of Makati City and clog our waterways that results to flooding in some areas in the city, he concluded.

The EO covers all supermarkets, public markets, shopping malls/department stores, grocery stores, convenience stores, restaurants, fast food chains, canteens, eateries and similar establishments. They are given one year to dispose all of their remaining stocks of non-biodegradable thin-film, single-use and carry-out plastic bags and styrofoams (polysterene) used as dining utensils, food, drinks and beverages containers, and other similar materials.

Business establishments will be required to quarterly and regularly declare their stock inventory of said materials to the Anti-Plastic Task Force (APTF) through the Department of Environmental Services (DES). The task force, with membership from DES, Law Department, Liga ng Barangay Office, Makati Action Center, Makati Health Department-Sanitary Inspector, Economic Enterprise Marketing Office, and Business Permit Office, will strictly monitor and recommend administrative sanctions to erring establishments.

All covered establishments must place a “Plastic Bag Recovery Bin” that should be visible, accessible and clearly marked. The recovery bin must be made available for the purpose of collecting, recycling and disposal of plastic bags. Moreover, each Barangay Hall will also be required to have a “Plastic Bag Recovery Bin” clearly marked which will serve as drop-off points to collect plastic bags from barangay residents. DES will coordinate with reputable recyclers/organized junkshop operators for the proper collection, transportation, recycling and disposal of plastic bags.

Violation of the provisions of the EO will be penalized in accordance with the penalty imposed in Ordinance No. 2003-095, as follows: Individual violators will be fined P1,000 or imprisonment of not less than five days but not more than 30 days or both at court’s discretion; while a corporation or establishment will be fined P5,000 or imprisonment (of owner) of not less than 30 days but not more than one year or both at court’s discretion.

A garbage contractor hired by the city that violates the ordinance will be penalized under the garbage hauling contract, if applicable. In addition to the penalties, the EO prescribes additional sanctions such as the cancellation of the permit and/or license to operate if warranted. The EO takes effect 15 days after publication in newspaper of local circulation and posting in conspicuous places in the city.
